In Balance Body Terms of Use and Privacy Policy
These terms govern your use of In Balance Body websites dashboards and related services and explain how we collect and use information.

Part One – Terms of Use
1. Agreement to these Terms
These Terms of Use form a binding agreement between you and In Balance Body GA LLC, a Georgia limited liability company with its principal place of business at 8735 Dunwoody Place Number 10730, Atlanta, Georgia 30350. By accessing or using any In Balance Body website, application, portal, dashboard, text message service, or related online service, you agree to these Terms and to any additional terms that apply to specific programs. If you do not agree, you must not use the services. If you access the services on behalf of a business or entity, you represent that you are authorized to bind that entity and that the term you includes that entity.
2. Relationship to Other Agreements
Certain users enter separate agreements with us or with affiliated professional entities. These include Management Services Agreements, Professional Partner Agreements, Member Agreements, or Business Associate Agreements. If there is a direct conflict between these Terms and a signed agreement that specifically governs your relationship with us, the signed agreement controls to the extent of the conflict. These Terms continue to apply to all other uses of the services.
3. No Medical Advice and No Emergency Use
In Balance Body provides diagnostic coordination, educational content, data visualization, and decision support tools. Clinical services are delivered by independent physician owned professional entities, not by In Balance Body. Information available through the services, including articles, metrics, dashboards, reports, and recommendations, is for general education and lifestyle support only. It is not a substitute for personalized medical advice from a licensed clinician. Nothing in the services creates a physician patient relationship with In Balance Body. The services must never be used for emergencies or urgent conditions. If you believe you are experiencing a medical emergency, call emergency services immediately.
4. Eligibility and User Accounts
You must be at least eighteen years old and legally able to enter a binding contract to use the services. Certain features require account creation. You agree to provide accurate and current information and to keep your information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly if you believe your account has been accessed without authorization.
5. Acceptable Use
You agree not to use the services for unlawful purposes or in ways that could damage or impair the services or interfere with other users. You agree not to attempt unauthorized access, reverse engineer components of the services, upload malicious code, misrepresent your identity, or use the services to harm or harass others. We may suspend or terminate access if conduct violates these Terms or threatens the security or integrity of the services.
6. Role of Diagnostic Programs and Professional Partners
Some features involve nonclinical partners who invite users into Body Map Scans or Body Math 360 programs. These partners are independent and are not employees or agents providing medical services. Partners may receive compensation from In Balance Body for marketing or enrollment activities under separate agreements. Diagnostic programs organize data and support personalized planning. Clinical decisions remain exclusively with licensed clinicians.
7. Payments and Financing
If you purchase products or services, you agree to pay all applicable fees on the terms presented at the time of purchase. We may use third party processors for payments or financing. Your use of those services may be governed by the processor own terms. We may suspend access if payments fail or are charged back.
8. Intellectual Property
The services, including the Body Math 360 and Body Map Scan names, diagnostic flows, software, designs, and content, are owned by In Balance Body or its licensors. Subject to compliance with these Terms, you are granted a limited revocable license to access and use the services for personal use or for internal business use if you are a professional partner or clinician. You may not use In Balance Body trademarks or brand assets without written permission.
9. User Content
You may upload or submit content. By providing content, you grant In Balance Body a worldwide nonexclusive royalty free license to use, reproduce, modify, adapt, publish, and display that content for operating and improving the services, subject to the Privacy Policy and applicable laws. You represent that you have the necessary rights and that your content does not violate third party rights or any law.
10. Third Party Services
The services may reference or link to third party websites, laboratories, pharmacies, or applications. In Balance Body is not responsible for third party content or services and does not endorse them unless expressly stated. Your use of third party services is at your own risk and may be governed by their terms and privacy policies.
11. Changes to the Services and to these Terms
We may modify or discontinue parts of the services at any time, subject to honoring paid commitments. We may update these Terms as needed. When changes are made, we will update the effective date and may provide additional notice. Continued use of the services after changes indicates acceptance. If you do not agree, you must stop using the services.
12. Disclaimers
The services are provided on an as is and as available basis. To the fullest extent permitted by law, In Balance Body disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and noninfringement. We do not guarantee uninterrupted access or error free performance.
13. Limitation of Liability
To the fullest extent permitted by law, In Balance Body will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or relating to the services or these Terms. Total liability will not exceed the amount paid to In Balance Body for the service giving rise to the claim during the twelve months before the claim or one hundred dollars, whichever is greater.
14. Indemnification
You agree to indemnify and hold harmless In Balance Body and its owners, officers, employees, and agents from claims, damages, or losses arising out of your use of the services, your violation of these Terms, or your violation of another person’s rights.
15. Governing Law and Dispute Resolution
These Terms are governed by Georgia law except as preempted by federal law. Disputes will first be addressed through good faith discussion, then nonbinding mediation in Georgia before litigation, except that either Party may seek temporary injunctive relief to protect its rights.

Part Two – Privacy Policy
17. Scope of this Privacy Policy
This Privacy Policy explains how In Balance Body GA LLC collects, uses, discloses, and protects information when you access or use our websites, applications, portals, dashboards, text systems, or related online services. This Policy applies to information we collect directly through these services. It does not govern the privacy practices of independent physician owned professional entities or other third parties that provide clinical care under separate policies or notices of privacy practices.
18. Information We Collect
We may collect information that identifies you or can be reasonably linked to you. This includes your name, contact information, account details, demographic information, and anything you submit through forms or assessments. We may collect health related information you provide, including goals, symptoms, lifestyle inputs, and responses to diagnostic questions. When such information becomes part of a clinical record under the control of a professional entity, that entity is responsible for compliance with applicable health privacy laws. We also collect information automatically when you use the services, such as device identifiers, browser type, time stamps, pages viewed, and approximate location based on IP address. Some data is collected using cookies or similar technologies.
19. How We Use Information
We use information to operate and improve the services. This includes account creation and management, responding to questions, coordinating diagnostics, personalizing content, generating insights, performing analytics, enforcing our agreements, and meeting legal obligations. We may use deidentified or aggregated information for analytics or development. When information is deidentified or aggregated, we will not attempt to reidentify individuals except as permitted by law.
20. How We Share Information
We may share information with service providers that perform tasks for us, such as hosting, analytics, support, payments, messaging, or customer operations. These providers must protect the information they process on our behalf. If you participate in diagnostic or clinical programs, we may share information with licensed clinicians and professional entities as required to coordinate services. Those entities are responsible for their own health privacy compliance. We may disclose information as required by law or legal process, to respond to lawful requests, or to protect the rights, property, or safety of In Balance Body, our users, or others. We may also share information as part of a business transaction such as a merger, acquisition, or asset transfer, in which case the successor may continue to use information consistent with this Policy.
21. Cookies and Similar Technologies
We may use cookies and related technologies to remember your preferences, understand how you interact with the services, and improve your experience. You may adjust your browser settings to refuse cookies or alert you when cookies are used. Some features may not function without cookies.
22. Data Security
We maintain administrative, technical, and physical safeguards designed to protect information under our control from unauthorized access, use, or disclosure. No security system is infallible. You are responsible for protecting your login credentials and securing your own access to the services.
23. Data Retention
We retain information for as long as needed to fulfill the purposes described in this Policy, meet legal and compliance obligations, resolve disputes, and enforce agreements. Retention periods vary depending on the type of information and applicable law.

We may still send service related communications. In some jurisdictions you may have rights to access, correct, or delete personal information or to object to certain uses. The services are not intended for children under thirteen, and we do not knowingly collect information directly from children under that age. If we discover such information has been collected, we will take reasonable steps to delete it as required by law.
26. International Users
The services are operated from the United States. If you access the services from another country, you understand that your information may be transferred to and processed in the United States or other jurisdictions that may not provide the same level of data protection as your home country.
27. Changes to this Privacy Policy
We may update this Privacy Policy from time to time. When changes are made, we will revise the effective date and may provide additional notice as required by law. Continued use of the services after changes take effect constitutes your acknowledgment of the revised Policy.

We may update these Terms and this Policy from time to time. When we do, we will update the version and effective date above.
